CCPA/CPRA Notice

This notice for California residents explains your rights and our data practices under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA).

§ 01

Introduction to CCPA/CPRA

The California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), grants California consumers specific rights regarding their personal information. This notice describes those rights and explains how California consumers can exercise them.

This notice applies to visitors, users, and others who reside in the State of California ("consumers" or "you").

§ 02

Definitions Under CCPA/CPRA

Personal Information (PI)

Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

Sensitive Personal Information (SPI)

A subcategory of PI that includes specific types of data such as social security numbers, driver's license numbers, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, union membership, content of mail, email, and text messages (unless OCXLY is the intended recipient), genetic data, biometric information, and health information.

Sale

Selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to a third party for monetary or other valuable consideration.

Share

Sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.

§ 03

Your California Privacy Rights

As a California consumer, you have the following rights:

  • Right to Know: You have the right to request that OCXLY disclose what personal information we collect, use, disclose, sell, or share. This includes both categories of personal information and specific pieces of personal information.
  • Right to Delete: You have the right to request the deletion of personal information that OCXLY has collected from you, subject to certain exceptions.
  • Right to Opt-Out of Sale or Sharing: You have the right to direct OCXLY not to sell or share your personal information to third parties. OCXLY does not sell personal information. You can opt-out of sharing for cross-context behavioral advertising via our Cookie Settings.
  • Right to Correct Inaccurate Personal Information: You have the right to request that OCXLY correct inaccurate personal information that we maintain about you.
  • Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to direct OCXLY to limit the use and disclosure of your sensitive personal information to that which is necessary to perform the services or provide the goods reasonably expected by an average consumer.
  • Right to Non-Discrimination: You have the right not to receive discriminatory treatment by OCXLY for the exercise of your CCPA/CPRA privacy rights.

How to Exercise Your Rights

To exercise any of the rights described above, please submit a verifiable consumer request to us by:

  • Email: Send an email to [email protected] with the subject line "CCPA/CPRA Request".
  • Cookie Settings: To opt-out of the "sharing" of personal information for cross-context behavioral advertising, you can adjust your preferences via the "Cookie Settings" link in our footer and disable the "Marketing & Personalization" category.

Your request must: (1) provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and (2) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

§ 05

Verification Process

Upon receiving your request, we will take steps to verify your identity to ensure that the personal information we hold is not disclosed to anyone other than you or your authorized agent. We will generally verify your request by matching the information you provide with personal information we have on file.

If you are using an authorized agent to submit a request, we may require proof of your written permission for the agent to act on your behalf, and we may still require you to verify your identity directly with us.

Personal Information We Collect

In the preceding 12 months, OCXLY has collected the following categories of personal information:

  • Identifiers: Such as IP address, unique device identifiers, and email address (if provided by you).
  • Internet or other similar network activity: Such as browsing history, search history, and information regarding your interaction with our website.
  • Geolocation data: Approximate location derived from IP address.

We do not collect categories of sensitive personal information unless explicitly provided by you (e.g., in a support request) and only use it for the purpose for which it was provided.

Purposes for Collecting Personal Information

We collect your personal information for the following purposes:

Sharing Personal Information

OCXLY does not sell personal information. We may "share" personal information for cross-context behavioral advertising purposes if you have granted consent for "Marketing & Personalization" cookies. You have the right to opt-out of this sharing at any time via our Cookie Settings.

We may disclose your personal information to third parties for business purposes, such as service providers who assist us in operating our website (e.g., hosting providers, analytics providers like Google Analytics). These service providers are contractually obligated to keep that personal information confidential and not use it for any purpose except for performing the services for us.

Minors Under 16 Years of Age

OCXLY does not knowingly collect personal information from minors under 16 years of age. If we learn that we have collected personal information from a minor under 16 without verifiable parental consent, we will delete that information. Policy Updates

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on the website and update the "Last Reviewed" date. Your continued use of our website following the posting of changes constitutes your acceptance of such changes.
